The European Court of Justice (ECJ) has ruled that France failed to apply a European Commission (EC) decision of August 2004 that requested that the country recover corporate tax aid awarded to France Telecom between 1994 and 2002. The ECJ confirms that the amount to be returned is between EUR 798 and EUR 1.14 billion in cash. The exact amount originally was due to be defined by the EC in collaboration with the French authorities by 1 November 2004. France rejected the EC’s proposals setting the amount of aid to be recovered and presented no alternative position to calculate the sum due. The EC said it will now contact the French government to demand that it put into action its decision as soon as possible, thus meeting the requirements of the ECJ ruling.
