 InterDigital files complaint against Nokia with ITC(USA)

Mobile technology provider InterDigital announces that its wholly-owned units InterDigital Technology and InterDigital Communications have filed a complaint against Nokia with the US International Trade Commission (ITC). It accuses Nokia of engaging in unfair trade practices by importing into the US and selling certain 3G phones and components that infringe two InterDigital patents. InterDigital has also filed a complaint with the US District Court for the District of Delaware, alleging that Nokia’s 3G mobile phones and components infringe the two patents named in the ITC complaint. The complaint filed with the ITC seeks an exclusion order to bar the infringing 3G mobile handsets and components that are imported by or on behalf of Nokia from entry into the US. The complaint identifies Nokia’s N75 handset as infringing InterDigital’s patents. InterDigital is also seeking a cease and desist order to prevent further sales of infringing Nokia products that have already been imported into the US. InterDigital CEO and president William J Merritt said the company was taking legal moves to protect its intellectual property rights after failing to reach a 3G patent licensing agreement with Nokia.
