 KPN fined EUR 2.88 mln by Opta (Netherlands)

Dutch regulator Opta has imposed a fine of EUR 2.88 million on incumbent KPN for failure to notify the regulator of discounts offered to two large corporate customers. Due to its dominant market position, KPN is required to clear certain pricing structures with Opta in order to ensure a level playing field on the fixed telephony market. In this case, the company offered the two companies selective pricing in order to maintain them as customers. The services were worth in total EUR 4.5 million over the period early 2006 to mid-June 2007. Opta discovered the case due to a complaint from a competitor. Opta said it increased the amount of the fine as KPN should have known already from past cases that it was in violation of the competition law. In July, the operator was fined EUR 1.6 million, also for offering corporate discounts without approval from the regulator.
