TRAI to come up with new telemarketing guidelines soon (India)

TRAI has stated that it will soon be announcing new date for implementation of new telemarketing guidelines.

According to Telecom Regulatory Authority of India (TRAI) Chairman J S Sarma, DoT (Department of Telecom) should be able to take a decision in about 15-days.

TRAI, which was supposed to implement the guidelines by March 21, had postponed it without giving a new date.

According to the telecom watchdog, the implementation is getting delayed as DoT is yet to submit a series of landline numbers to it which will make it difficult for telemarketers to operate from mobile networks.

The new regulation, which calls for restricting unwanted calls and imposition of steep penalties on offenders, was first supposed to be implemented from January 1 this year but has been delayed thrice till now.

Sarma also stated that TRAI will issue a discussion paper on the 4G mobile services in a couple of months. They expect to complete the recommendations made on equipment manufacturing, green telecommunications as well as infrastructure policies by month end after which they will take up 4G. Along with 4G, TRAI will also be holding discussions on other subjects like IUC charges and reforming and liberalization of spectrum.

India’s active wireless subscriber data shows diverging trends

Fitch Ratings has announced that the Telecom Regulatory Authority of India’s (TRAI) disclosure since December 2010 of the number of active wireless subscribers based on a visitor location register (VLR) provides a clearer view on subscriber market share and other key operating indicators such as average revenue per user (ARPU).

In particular, Fitch noted that the information diverges from the key data previously reported by revealing that market share for operators may have been distorted by the inclusion of non-active customers in the subscriber count. The data further revealed that the ARPUs of some telcos which have a lower active subscriber base are much higher than reported ARPUs figures.

The VLR is a point-in-time database of active subscribers in a particular cell site. The total VLR count for an operator represents the sum of all active users across all of its cell sites at any given point-in-time. As any one subscriber cannot be present in more than one VLR, this measure provides a more accurate representation of an operator’s total subscriber count.

According to figures published by TRAI on 4 March, active customers at end-January 2011 totaled 548.6 million against a previously reported 771.2 million, reflecting a much lower mobile teledensity of 46.1% against a reported 64.7%. Fitch believes that the introduction of mobile number portability from January 2011 should help reduce the exaggerated total subscriber counts by removing non-active users from the operators’ subscriber books to a certain extent over the long-term.

The TRAI data shows Bharti Airtel, Vodafone Essar and Idea Cellular to be enjoying a higher VLR market share of 26.3%, 18% and 13.9% against a reported 20.2%, 16.5% and 10.9%, respectively. Conversely, VLR market share is lower for Reliance Communications, Tata Group and Aircel / Dishnet wireless with 15.6%, 7.8% and 5.7% against a reported 16.7%, 11.2% and 6.7%, respectively. Mahanager Telephone Nigam Limited (MTNL) and Bharat Sanchar Nigam Limited combined also have a lower VLR market share of 9.1% against a reported 12.2%.

The VLR data reveals that operators with a low proportion of active customers have significantly higher ARPUs than previously reported levels. MTNL, for whom active customers only represent 36.6% of its subscriber base, has an ARPU that is 150%-200% higher than the previously reported level. In contrast, Bharti and Idea, both of whom have the highest representation of active customers at 92.6% and 90.3% respectively, are shown to exhibit ARPUs that are only 9%-10% higher than reported ARPUs. For operators like Rcom and Vodafone, with 66.3% and 77.7% of active customers respectively, ARPUs are shown to be higher by 30%-50%.

The data also shows that in terms of network circles, Jammu and Kashmir have the highest proportion of VLR subscribers with 81.3% followed by Assam at 81% and Maharashtra (excluding Mumbai) at 77.6%. Mumbai has the lowest proportion with 59.6% followed by Kolkata with 62.45%.

Fitch believes that new entrants in the sector are facing increasing difficulties with few active customers and an uncertain regulatory environment. For instance, Etisalat DB, Uninor and Videocon Telecom all have a much lower active subscriber base at 33.5%, 46.7% and 49.7% respectively. For private incumbents, barring regulatory uncertainties, the credit outlook is stable on expectations of limited decline in average revenue per minutes and likely strong subscriber growth with moderate wireless mobile penetration. The agency expects telcos to continue investing heavily to expand 2G coverage and roll out 3G networks which should keep free cash flow generation for most Indian telcos in negative territory.

Nevertheless, Indian telcos are expected to improve their weaker balance sheets on the back of the planned sale of stakes in their tower businesses in 2011.

 

38.3 lakh mobile users opt for MNP (India)

Telecom Regulatory Authority of India (TRAI) has revealed that the number of mobile subscribers opting for mobile number portability (MNP) has been more than doubled in less than a month in the country.

TRAI stated that by February-end, around 38.33 lakh people had opted for MNP. The service allows subscribers to switch service providers but retain their original mobile number.Till February 5, about 17.11 lakh subscribers had put in requests for changing their mobile service provider.  

TRAI receives maximum subscriber complaints against Bharti Airtel (India)

India’s largest mobile operator, Bharti Airtel has topped in the subscriber complaints related to billing, metering and tariff-related issues and activation of value-added services without customer consent. In the last three years, TRAI received almost 3,571 complaints from Bharti Airtel subscribers.

Other telecom major Vodafone received 1,896 complaints. However, Tata DoCoMo and Idea Cellular were on the bottom of chart with 1,239 and 925 complaints, respectively.

The total number of complaints received during the last three years stood at 10,561. The regulator has forwarded these complaints to the concerned service providers for appropriate action.

According to Minister of State for Communications Sachin Pilot, Telecom Regulatory Authority of India (TRAI) has been receiving complaints against telecom service providers, alleging various problems which include billing, metering and tariff related issues and activation of chargeable value added services without explicit consent of the customer.

TRAI has notified Telecom Consumers Protection and redressal of Grievances Regulations, 2007 which makes it mandatory for every service provider to establish a three-tier system consisting of call center, nodal officer and appellate authority for redressal of grievances of telecom consumers.

TRAI extends deadline for pesky calls (India)

Telecom Regulatory Authority of India (TRAI) has extended the deadline for implementing new rules to control the menace of unwanted calls and text messages till March 21.

The regulator extended the deadline for the implementation of new rules, which would have relieved the mobile subscribers of pesky telemarketing calls and text messages, for the third time on telecom operators’ pleas. Originally, it was to be implemented on January 1, 2011 but was extended to February 1 and later to March 1.

TRAI cited the delay in allocation of a uniform number series for fixed line telemarketers by the Department of Telecom (DoT) as the reason for deferring the new rules.

As per TRAI guidelines, it had suggested a hefty penalty of up to US$5540.75 on erring telemarketing companies. DoT had allotted a new ’140′ series for telemarketers, instead of one starting with ’70′, as recommended by TRAI.

Telemarketers to get new landline number series (India)

The government is expected to issue new numbers for telemarketing calls originating from land line phones to help customers recognize unsolicited calls, in line with the separate series for mobile telemarketers. The new number is likely to be issued this week.

The Department of Telecommunications (DoT) has already issued a number series starting from ’140′ for calls and SMS made from mobile services of registered telemarketers.

According to TRAI officials, they are in discussion with senior officials of DoT. The number series has to be issued by DoT… (It) will be done by Monday or latest by Tuesday.

The Telecom Regulatory Authority of India (TRAI) has come up with regulations to curb the menace of unsolicited calls and SMS sent to telecom subscribers.

The regulation will come into force from March 1, 2011, after which customers registered in the do-not-disturb list will get relief from pesky calls and SMS from telemarketers.

TRAI has asked the DoT to issue a separate series of numbers for both mobile networks and basic phones of telemarketers to help consumers differentiate between calls coming from telemarketers and others.

The DoT, in a communication to TRAI, had stated that the new series of ’140′ cannot be used for both basic and mobile services. Levels for basic services will be allocated after resolving the issue of caller line identification (CLI) for telemarketing operations using basic services. All the issues regarding basic phone service has been resolved.

However, telecom marketing companies do not seem prepared. On conditions of anonymity, a telemarketing firm stated it was yet to receive the new series of landline number.

One representative of a telemarketing company stated that there are few days left when their existing telecom resources will be withdrawn. They are worried for their business. Telecom companies are not issuing them basic phone connections as they say that they are yet to receive new numbers from the DoT.

In a recent notification, the telecom regulator had asked telecom companies to withdraw telecom resources, including existing telecom connections issued to telemarketers by February 28, 2011.

Unsolicited calls, SMSes to end soon: TRAI

The Indian telecom regulator TRAI has promised that it will cease all the unsolicited calls and SMSes that troubles the mobile customer.

According to J.S. Sarma, chairman, Telecom Regulatory Authority of India, they are working on a system of telecom consumer grievance monitoring system. The grievance will be monitored by TRAI and time-bound replies will be ensured to you. This will be launched shortly.

Over the next few days, the regulator would come up with regulations to bring to a close unwanted SMS and calls of commercial nature.

Mobile number portability to start today (India)

The mobile number portability (MNP) service is set to start in Haryana from today.  Mobile users will have the option of changing their service provider without changing their mobile numbers.

MNP service in rest of the service areas across the country will be implemented in a phased manner after its launch in Haryana.

According to Telecom Regulatory Authority of India, the maximum time period for transferring would become seven working days except in Jammu & Kashmir, Assam and North East licensed service areas, wherein it would be 15 working days.

Customers willing to avail the service will have to send an SMS from their phone to 1900. On these bases, they will get a unique porting code as SMS from the existing service provider.  The customer can then make an application in the prescribed form mentioning the code to the selected new service provider for porting of number.  A period of seven days has been prescribed for completion of porting  of the mobile number to the network of the new service provider.

BSNL & MTNL top chart for dead lines in India

www.WirelessFederation.com/news: According to a latest data analysis for performance from October to December of 2009 by Telecom Regulatory Authority of India (Trai), the average mobile across Mumbai lost connectivity for 3 hours and 22 minutes a month while average cell phone in Mumbai couldn’t get network for 1 hour and 39 minutes per month.

State telecom operators- Mahanagar Telephone Nigam Ltd (MTNL) and Bharat Sanchar Nigam Ltd (BSNL) fared the worst when it came to network unavailability and the subscribers of the private players had much better connectivity. According to Trai, no provider should make a network unavailable to a subscriber for more than 14 hours and 24 minutes a month. In Mumbai, MTNL had their cellphones disconnected from the network for an average of 8 hours and 21 minutes a month. While BSNL in the rest of the state had their cells disconnected for an average of 13 hours and 27 minutes a month. However, both were still within the permissible limit set by Trai.

As far as private players are concerned, Bharti Airtel disconnected its network for 2 hours and 26 minutes a month, Reliance, Loop and Tata lost connectivity for 43, 38 and 17 minutes a month respectively while Vodafone Essar and Idea Cellular fared the best, with their Mumbai connections losing connectivity for only 8 minutes a month.
In terms of the amount of calls getting disconnected due to network problems, MTNL and BSNL again fared the worst, but stayed within the permissible limit of 2%. The average number of calls getting disconnected in Mumbai as well as in Maharashtra was around 1%.

According to service providers, the number of call drops on flyovers or railway bridges had come down drastically because of the installation of boosters on streetlight poles as Maharashtra State Road Development Corporation (MSRDC) has allowed the installation of transmission equipment atop streetlight poles as most flyovers and bridges were dead spots for mobile connectivity and it is not possible to erect the usual network towers atop flyovers and bridges.
