US mobile operator Verizon Wireless has filed an appeal against the rules adopted by the Federal Communications commission for an upcoming spectrum auction. Following pressure form a number of content and software companies, the FCC has required the winner of the bid for around one-third of the spectrum to run an ‘open’ network, on which any kind of handset, with any type of software application, can run. In a filing to the US Court of Appeals for the District of Columbia, Verizon Wireless said the rules are “arbitrary, capricious, unsupported by substantial evidence and otherwise contrary to law”. A person familiar with the matter told the Wall Street Journal that Verizon was mainly unhappy with the requirement to allow mobile users to be able to download any type of software application to their handset. Verizon declined to comment beyond its filing.
